Hmmm. Seems the question needs to be refined a bit. From the way you asked it, I would say, "Yes". LOL I think it depends on the issue being ruled on in the Colonial Case and if any of the issue in the Colonial proceedings mirror issues that are unresolved in the WAMUQ proceedings.

I posted a few days ago regarding the "Equity Sexurity Holders Reservation of Rights Regarding Certification of Counsel Regarding Stipulation Regarding Establishment of Segregated Account" in the WAMUQ case as it applied to the NOLs. The Colonial Case seems to be creating the precedent for the WAMUQ segregated account as is mentioned in their 8-K.

Actually this is another refresher to the fact that FDIC can be, has been, and will be ruled against. The FDIC is not above the law.

This was summary judgment, several months ago they lost a summary judgment over a claim to NOLs. An earlier judicial opinion call them "despicable ".

I wish I had better research capacity to compile a list of FDIC defeats.

Whether or not it is completely relevant to WAMU will be argued and debated by the lawyers. Clearly it is and clearly it is not will be the two opposing arguments.

The case could potentially impact other bank holding companies which have filed for bankruptcy after their lending business was taken over by regulators.

Great find...and posted by one of my fav ihubbers HDOGTX. I believe that has an incredible bearing on our case in a positive way. The FDIC has openly stated the wamu seizure cost them nothing....and JPM has done nothing but make money from the gift given to them by the FDIC. They have absolutely no right to NOL refunds...and many other assets.
