Actually this is another refresher to the fact that FDIC can be, has been, and will be ruled against. The FDIC is not above the law.

This was summary judgment, several months ago they lost a summary judgment over a claim to NOLs. An earlier judicial opinion call them "despicable ".

I wish I had better research capacity to compile a list of FDIC defeats.

Whether or not it is completely relevant to WAMU will be argued and debated by the lawyers. Clearly it is and clearly it is not will be the two opposing arguments.
