Between, I actually understand what you are saying.

And I hold out judgement because of it. I see the difference between reading the P&A, and it's language, vs. the FDIC's manual, and it's language.

And Boston's FOIA - the new actual amendment itself, and it's language. ( http://www.ghostofwamu.com/documents/WaMu083010SettlementDateExtension.pdf )

I think it will be interesting when the FDIC and/or JPM decide to reply to the journalists asking the questions now. And we will get some clarity there.

Obviously the ultimate clarity will come with THJMW, but that is a bit further off.

So for now, I'll look forward to this:

I called the FDIC to ask about it. “I’m trying to find out more about that,” said spokesman Andrew Gray. He indicated he'd received other queries on the matter, and promised to get back to me when he has a response from FDIC officials. A spokeswoman for JPMorgan Chase said she was looking into it, too.

I would think the Examiner will report to the Judge the fair market VALUE of the litigation claims.
