What I don't understand is how the proposed order for the examiner can be filed by the Debtors when they object so hard to the appointment. It would make more sense to me if it was the UST or the EC. Even if its is an agreed order.
3. Consistent the Court's rulings made at the hearing held on July 20, 2010 and the telephonic hearing held on July 22,2010, attached hereto as Exhibit A is a proposed form of order directing the appointment of an examiner(the "Proposed Order").
It looks like this order was agreed to by all parties today via phone conference with the judge.
