Old ways Old days

Inherent in what you write is, I believe, a broad misconception. We are taught, when little, about concepts like right, justice, ethics, and such. We often take these teachings and extend them to and across institutions in the country like the legal system. When we do this often we assume that these institutions, like courts, will just automatically, and magically produce results we like, or approve of, with no consideration or regard for how these entities function.

Courts, especially BK courts, exist to resolve disputes between parties. That is basically so that disputes may be resolved w/o resort to guns and axes. That's a very simple two sentence statement about very complex issues. Another short sentence to go along with those is: If you're not represented in court when a dispute is considered, your interests may not be, and usually aren't, taken into account by the court. In the past, with certain specific, and other rare exceptions, C/S have not had representation, and therefore consideration, in BK courts.

Today is a different day. The democratization and universalization of information provided by the internet allows individuals and groups to see and examine what before could only be accessed by a few. This new ability, along with a similar ability to communicate with others, is giving rise to the growing demands to change practices and laws. The ability to communicate with others will beget a means to secure representation and with that a greater consideration of C/S interests in BK proceedings. Folk who want this are not usually 'common'. What they want whether it is 'Just', or not, is a piece of the 'pie'.
