IDCC agrees that this TDD Agreement is separate and unrelated to any 2G and/or 3G Agreements; that this TDD Agreement does not pre-suppose, in any way, ever, any settlements or payments of compensation under the 2G and 3G Agreements, since said 2G/3G Agreements specifically allow Nokia to challenge any patent claims in any way they choose, at any time, without penalty or forfeiture of any kind, including any rights to Nokia under this separate TDD Agreement.
Likewise, IDCC agrees that failure of any of the named manufacturers in the 2G/3G Agreements to license with IDCC permits Nokia a no-settlement option with no time limits and no penalty.
