i do believe that they can force them to resign via their ban from participating in a public company. i don't know about the process of going public to private. my point was that if the company gets its registration revoked and does go private, that there would then be nothing preventing m&m from being involved with the company.

Is it a wrong assumption to think that if the SEC can force a corporate officer to resign they can also force that corporate officer or any other corporate officer to give up their class B shares so they effectively turn control of the company over to the common shareholders?
