boarddork: At best all they can do is bring the wrongdoing to the courts attention. What they really truly need is the minutes to all of the meetings between all of the parties as well as the rule 2004 documents as well as further depositions that were never taken. The judges stern warnings are all fine and good but to date neither party has shown the slightest inclination towards settling in a manner acceptable to the equities.
