Correct me if I am wrong
But I think any settlement reach to eliminate FC claim will dismiss the case without prejudice , means no parties will be committed fraud.In that case,it's highly unlikely distinguish between pre /post shareholder.
The shareholder lost earning will have to pursuit their lost in other avenue such as , class action.But their chances are slim coz JPM/FDIC will get a release order from being sue twice for the same claim.

But you seem to be ignoring the fact that the "pre" stockholders decided to sell their shares rather than wait for justice. They sold not only their interest in the company but also their right reap the rewards of their investment.

If in the middle of the Kentucky Derby you decide to sell me your wager ticket and the horse comes in does that mean that you get the winnings?

I am a pre- and post- shareholder and I cannot see a distinction or a valid way to enforce the settlement.

Can you cite a particular instance where pre- sharholders were paid regardless of whether or not they still held the shares?

That would be a class action law suit for shareholders before sep 08. They would have a totally different case.

As far as the pre vs. post issue goes every share that is here today is a share that was there during pre seizure.

While it's true there may be a ton of naked short shares out there as well legally they should not be.

Anyone who sold the right to their wamu shares did so after evaluating the chance of settlement. Anyone who bought post seizure has complete and total right to their piece because they willingly bought that risk.

think of it like when someone buys a bunch of 'bad credit card debt' that the banks or credit card companies can't collect. they sell it to someone for pennies on the dollar. Then the person that buys it can potentially make a fortune, or lose everything. But the bank or credit card company can never come back and claim it, they sold all their rights to it. Cause someone else bought and took on the risk.

We are no different, Well technically I am holder pre and post. As a pre share holder i could have sold out a long time ago, and if i did whoever bought my shares would have every right as owner of my stock.

Everyone of us who bought after, saw that this was something we could win or lose big on. Every share I bought is a share i feel I legally own pre or post and everyone of those shares deserve to be whole. regardless of if i got them at 10.00 or .03 they are all legally entitled to settlement money.
