Yes they can buy shares back even though a material event may be in progress. In the past they set the buyback up in a way (can't remember what it's called)where it's automatic regardless of what's going on. I believe olddog can comment further on what I'm talking about.

I believe they can buy back despite being in possession of material facts, if the buy back program were initiated a priori.

Logically, a licensing firm such as IDCC would NEVER be able to buy back if that meant suspending the active pursuit of new licensees.

Of course, I'm using logic here...
