skooby...........I agree the lawsuit by Phanuel Pursuits is probably "sour grapes" - I just wish we were being informed more about it and did not have to find out about it from the "PP" poster (who I believe is directly involved with Phanuel Pursuits).
I also understand why CYGX cannot disclose information on an active litigation. Having said that, a release from CYGX given in a professional and informative manner to us, the shareholders, would be logical, helpful and legal.

Communication has been a horrible short-coming of CYGX.

The decisions behind a few news posts, released in past, have sometimes been mistakes i.e. the famous HVS mouse experiment carrot to be release in 30 days - over a year ago (I see that event as an impt. turning point in the trading of CYGX). Many of the releases from CYGX which are extremely impt. are somewhat lost among other releases which are almost but not quite fuff - this usually happens.
CYGX is a small developing bio-tech company which someday will grow into the great bio-tech company we all envision. When a developing company is in this stage, mistakes are made because there are so few to oversee the mistakes of the few others i.e. Berlin stock market listing - regarded by CYGX as a great plus and now possibly a disastor waiting to happen (?) - CYGX should examine this matter and get out of Berlin as other companies have done, if the stories are even remotely true regarding this market. Makes sense to me.
Making mistakes - we all do it - is normal but discovering our mistakes, recognizing them and doing something to correct them canbe the difference of success or failure. Anyone can make a mistake but a true and successful leader is needed to correct them and even admit to them.
Having stated this and on a positive note, all corporation of any note are involved in litigations - what is impt is how they handle it now and negotiating future partnerships.
As I have stated many times before, if CYGX is only successful in one of the many areas of investigation i.e.
sepsis - HVS - neoplasia - anti-inflammation - and so much more, the PPS will be a pleasure to watch.
I may have misgivings about management but I will always state that they have given all they are capable of - further growth and developement is mandatory in any venture such as CYGX especially in the management area and they must be aware of this fact.
I guess we can all agree that CYGX basically has been moving forward in a difficult area. Perhaps it is abit slow at times but that is the nature of the beast.
A massive improvement in PR/communications is needed on a professional and common sense level. Can't we all agree on this point?
However, we, as intelligent and informed and loyal shareholders, have a duty to keep management on their toes. Remember they do read this board and this is good.
Lets try to put these law suits on the nessecary attention level due them and nothing more and look to the present Pre-IND event at hand with postive minds.
IND's are impt ! and I feel that the present legal actions while not desired canbe learning points for the management at CYGX.
OUR TIME IS COMING (or near, depending on one's perception of time).

Are we heading toward clinical trials? Could two major lawsuits not derail such a train? More to my concern as an investor; were we heading to clinical trials in India when CYGX breached? If so, did they breach because they were looking for a bigger and better deal (as expressed by LW 3/2004 they were aproached and in negotiations with two large pharma companies with the intention to license the same herpes product PP owns)? I assume you base your view regarding clinical trials on the cygx pr-- "heading" towards clincals. I don't find that as comforting as you do considering the source of the information is the same source of information asserting PP was to conduct clinical trials in India. Based on our companies pattern its more likely that months will pass with no news on herpes followed by news that sepsis is heading for clinical trials? I accept your opinion that my comments can be negative; but this is science not a popularity contest. If they have a cure, then get it to the people who NEED it and get past whatever ego/lawsuit/stupidity/managerialB.S./delays/excuses crap and just delivery the product. If in fact CYGX or PP caused a delay b/c of greed then I hope they sleep well at night knowing that everyday they delay is another day that someone is waiting for this B.S. to end. If CYGX caused it, then to hell with them. If PP caused it, then to hell with them. If they both caused it, then to hell with both of them. This is not a cure for a minor scratch or bruise we are dealing with this is a cure for a deadly disease that cause many children to be born blind, individuals the world over to suffer pain and humiliation, and one which could help stop the spread of AIDS. Its a potential link to curing cancer for God's sake!! Personally, I don't give a shit what the reason is for all the delays. Fix it, Fire it, or get the fk out of the way. I target my negativity towards every single person who caused delays. They should all take a long hard look in the mirror and question wether or not whatever IT IS that IS the problem is really worth the pain that delay causes everyone. I am of the opinion that all involved are a bunch of s.o.b.s for this Mickey Mouse crap!!!!!!!

I do not understand the logic of this board. If we accept the premise; NO ONE KNOWS THE SPECIFICS OF THE LAWSUITS THE NATURE OR THE VALIDITY OF THE CLAIMS. Then can someone explain how bashers claim this is bad news for Cytogenix, and how skooby and others, also lacking knowledge of the specifics, can make the claim that the lawsuit is frivilous or worth 25,000.

Myself, I raise the question; If PP Shaun Fink and other so-called "bashers" are full of it, then how did the board start talking about lawsuits? It wasn't because CYGX told investors we had a problem. It was PP who informed this board their was a problem and lawsuits might result. At the same time CYGX said that funding was 30 days away. So who has credibility here? Or, put simply; Who was right?

Are we funded? NO
Did CYGX inform or tell investors? NO
Are we in a lawsuit? YES TWO OF THEM!!
Did CYGX inform or tell investors? NO
Did PP claim that clinicals were not underway
as previously touted by CYGX and PP? YES
Did PP claim that a lawsuit was possible? YES

PP, Shaun, Arnold, and others have credibility because the information they posted was accurate.

CYGX, Skooby, HOWARDJOEL, PAULNESS, have no credibility becasue the information they posted was not accurate.

Facts are Facts. So, S,H,P, please explain to me how I'm a basher of the stock for saying that PP, CYGX, and everyone responsible for the delay is at fault? To me all the cheerleaders and bashers making statements based on hunches and speculation are of no help to anyone. This is a forum to discuss the issues regarding are company, and right now the facts are we have no funding news as promised, we have nothing but preliminary talks with the FDA, we have two maybe three lawsuits facing us in the near future. We here nothing from CYGX and rumors from PP and others which I must admit have some element of truth to them. I would like to explore these issues. As I preached earlier; this is the purpose of the company.
