To me, he's just issuing an opinion. As no one (not even Jorge) can predict the stock price, I don't see how it could be classified as insider information.

I hope the IR firm is right about surpassing former highs and breaking into the .01's. This is my favorite part of the email:

"We are happy to have him as a client regardless of his unique management style and [we] are 1000% sure that in 2010 all buyers below .01 will reap huge benefits by the end of 2010."

I dont think there are legal ramifications if the company is stating an opinion and is not the actual company itself. It is what that company thinks and is not part of CXAC nor are they individuals in a high ranking officer position or board members for CXAC. They are contracted. Its like if CXAC contracted a plumber, the plumber would go in and do the work, then if he thinks the price will jump to .02 he is stating what he thinks, he is not an employee of the company itself and is not a member of the board, nor is he an officer. Even the phone operators could say what they thought and it would not matter.

I could talk about what I think will happen to the company I work for and say what I think the PPS would be and its not considered insider info. Unless I was a board member or high ranking officer.

Agree...e-mailed Jorge last night asking the same question. Paul-Alan speaking for Jorge without Jorge confirming the info given, is the equivalent of being given false info...could get the company in a lot of trouble...misleading the stockholders is never a good thing!
