I don’t remember enough about Marbury vs. Madison to comment on it but I do remember that is where the court determined it had a higher power than elected officials, both lawmakers and administrators. In a way the court was correct but in a way it was wrong and I don’t remember how it was wrong. It is interesting that one branch of government could give itself so much more power than the other coequal parts. If you don’t like how the law is interpreted then change it. If you don’t like how the law is administered then change it. The court is not suppose to make the law just determine its intent and enforce the law as it is intended.
If the FDIC can change the law no holder of any banking stock is safe. What the FDIC said today in court amounts to “we stole the bank once and if you don’t like it we will do it again” “We do not want these people to have anything we already took” it seemed to me that they were treading contempt when they said it.
All the power in the court belongs to the judge no matter what. No lawyer ether side has any power or say as to the judges’ decision no matter whether it is right or wrong. Just try getting out of a contempt charge and lord help you if the judge dies.
