I don't think the "leaders failed."

Most of what has gone on is beyond their control. These guys did what they could to change the outcome.

It was the Judge that delt most of the cards. These guys played what they were delt better than I expected.

If the Judge hadn't agreed to the settlement, this would be a very different situation. A good fight was put up against the settlement. The judge didn't see it that way.
