Thanks....I had completely missed that fact.

As you say, the Presidential order is a formality. I think it is safe to say that Nokia would continue to import product but that they would be risking the value of the bond that was put up. I can imagine the value of that bond could be another bargaining chip in negotiations.

Just what is your professional opinion, on Nokia going to risk a ban when even though they were found not to infringe, but to think that the commission would also find that you didn't infringe not one of the 16 claims might be mighty risky. The reason I express my concern is they could have afforded for Luckern to make a decision and if it went bad they was thinking no worse off as we now request the commission review and no ban is in effect. However if they let it go to the commission and the infringement is overturned the ban will go into effect in February, and the only relief they would get would be via bond, and hopefully a presidential overturn of the ban. Isn't this a extremely high risk, or do you think they will most likely settle, with IDCC getting close to if not all they are seeking. If they go the distance they have more guts than I would have for sure. I don't think the ban would start as soon as the commission rules but it would be even nicer if it did assuming they overturn the judge.

I don't know how many handsets and base stations will be involved, but even with lifting the stay in Deleware which if I was IDCC, I wouldn't be in any big rush to do Nokia would lose many millions waiting on a ending to the Deleware trial.
