Where do you get this theory from. Seems pretty boisterous from someone that is not personally a party to the case. You can't guarantee that these are collected and turned over. Why would JPM do that early and give them to the judge??? Especially if they have no intention of ever turning over the evidence as most suggest? Very outrageous and untrue post.
Even if you are going to try to argue that WMI already had them collected on their own, they would only have a few, not everything they are asking for.
