Mata Hari, you are not considering the 2008 $50,000 minimum royalty payment that Abbott was obligated to pay regardless of any amended agreement. If you noticed in the signed amendment, it is clearly defined that the 2008 payment is specifically not to be paid. You could conclude that the agreement to NOT do a product return was paid for with the $50,000 payment.
