Publishing that so called "settlement" may be considered constructive notice.

Seems pretty flimsy, but they could argue they didn't have to contact each unit holder individually because they published it in the newspaper of record (if in fact it it was).

Kind of like what we see in the legal notice section of the paper when one proclaims they will be responsible for "no debts other than my own."

That serves as constructive notice to the world and creates a date of reference. Relieves the party above of the necessity of contacting individual creditors.

Like I said it seems flimsy to me, especially with what is at stake, but that might be a line of reasoning. GL i.
