the User Agreement can say "you can get murdered here, enter at your own risk"

however, murder still remains a crime, and those that commit it are subject to prosecution - the fact that someone presses "I Agree" makes no difference

I'm afraid the point is missed.

The newbies spoken of here had not a clue that the ihub swimming pool was a "swamp filled with alligators" as it was put it.

Now, if the TOS had said something along these lines...." Among other illegal activities, ihub reads your PM's and will work against you to steal your money" and the newbies went swimming anyway, well then the argument would be valid. IMO, thats the "con" part of the "sting": ihub lulls investors into thinking they have a secure, stand up site when in fact it is a snake pit. Why else would ihub manipulate the flow if information if not to con newbies out of their money?
