The charge that NVS has obtained by unlawful conduct trade secrets that would allow it to manufacture the Copaxone product to the tolerances of the TEVA process, should, if established, support injunctive relief prohibiting NVS from making the product. Nor should it be sufficient for NVS to claim that they or their partner produced the product by totally innocent means. They and theirs should all be enjoined. There is no way to know what a judge will do faced with the facts but I would want to deprive the thief of the benefits of the theft.
