Unlike Dubya, Obama knows that he can't change a statute by issuing an executive order.

There is an exception in the FOIA statute for on-going criminal investigations. There is no way that the feds will let the criminals use FOIA to see what the feds are investigating and what they have found so far. ... eom

What was issued yesterday was a memorandum which included a statement that there should be a presumption of disclosure and directing the Attorney General to issue new guidelines concerning FOIA to executive agencies and departments and, also, to publish the new guidelines in the Federal Register.

Presumptions are rebuttable and this memorandum is far from a cry of "come and get it" Osama!

However, there was an executive order issued about claiming executive privilege by ex-presidents whose section 4 should trouble Dubya and Cheney:

I am responding this way because you didn't have your facts right about what happened. Obama is not going to let criminals see what the FBI has compiled about them in an on-going criminal investigation. I know it's hard but, from now on, let's try to keep personal political points of view off this CMKX board. ... eom
