Ignoring all the technical issues... on which we disagree...
What is your analysis of the percentage of those who are on that list who will opt to fork over the $$$ if Nexicon sends them an e-mail... and has a summons and provides service moments after the file is processed and disposed of rather than being acted upon... ???
The odds in their analysis totally ignore the non-technical and legal elements of social engineering... as well as the practical reality that the law is not now and never will be on their side.
How many of those on that list need to be sued... before the entire list alters its perspective of the risks and rewards... ???
On the technical and legal side... I will keep my own counsel rather than rely on the flamboyantly expressed but otherwise substance-less opinions of those with vastly less perspective and experience than I have in the legal, technical, social, political... and "other" strategic focus issues... that are driving change in the entertainment industry.
I should note that the bulk of what I see expressed as opinion on the subject is wholly irrational... and that it would be useful in evaluating the reality here, for you to apply a fairly rigorous test of logic in the effort. Noting again... not all opinions are equal... and any useful effort in analysis here should not be based on others opinions, rather than original work to parse the legal, technical and market realities. Do your homework... be critical.. rational... but ask questions before you post recycled opinions as facts.
