Your postulates are strong in theory but in vast scheme of things in the online IP rights war it is clear you don't understand the scope and scale practical challenges faced by anyone, much less Nexicon, fighting Internet piracy. Some poster making the reactionary comments obviously understand them and others like you clearly don't. I contend the author does, thus his out of hand dismissal of Nexicon's ability to execute.
Just because the company say so, does not make it so. They have been touting their ability to find and process billions of records ever since I heard of them. I have not seen it yet and know noboby who has.
I don't have time right now to address your finer points, perhaps later. I do wish I could because, I believe your points come from intelligence. Nonetheless, I encourage you to learn the practicalities of the DMCA, and every step it takes to catch an infringing downloader and get him a C&D. That can be done pretty easily....but what to do when there is non-compliance? Sue you say...sure, then you better have the resources of the RIAA and I don't believe Nexicon has that. C&D's are a hammer and anvil approach to the issue. The C&D are the hammer...but you targets better believe in the anvil of litigation on the other side other wise Nexicon business model will be seriously flawed...which I, and many like the posters below the techdirt article firmly believe.
