I checked my notes, and found a barely-legible reference to the relevant US use patent expiring in 2016. It was filed before the law changed, and I believe had a duration of 17 years from 1999.

But GSK could be hoping the EU use patent will be overturned--though I think the 2014 date applies to that EU patent. In which case the patent matters little if at all, commecialization in the EU could not occur until 2014 anyways. GSK is one of the parties to the EU suit, so that could be their rationale.
