Durn good question. Ketch's response on the RAQ was:
Both cases of licensing pre-date our license and development agreement with ANI and were known to us before we entered into the relationship. Neither case allows another company to license the Embarq™ enhancements, thus there is no scenario where a competitor could come to market in outside plant wireline telephony with an Embarq™-like product.
Once again, as I pointed out when the RAQ came out, the question was not really answered. The answer that was given was also incomplete and misleading, in my opinion. Ketch states that the "Embarq enhancements" could not be used, but the technology briefing last year clearly stated that "Powerstream" comprised 80% of Embarq. So, two other companies have the rights to 80% of what makes up Embarq.
One further note - some time ago, late summer last year, I believe, Ketch made the statement that the Embarq FPGA design was complete. He said it was "frozen". Now, nearly a year later, we still do not have an FPGA. Who thinks Ketch was being honest about the design being "frozen". Anyone? Show of hands?
