mschere, things keep getting worse for NOK. Imagine the thought of coming back to the ITC after using the court system to delay the ITC proceedings, and basically overrule the new Chief ALJ's decision regarding NOK's waiver of right to arbitration by engaging in litigation. Who they gonna go to in the ITC now?
OT: mschere: As you surmised, unless he was a child protege, Judge Luckern must be in his high 70's. He graduated in the class of 1951 from Georgetown. He really must like his work. I retired as early as I could.
