Nice find Olddog. The judge sounded aggravated. I would love to have heard the tone of his voice. Geez, now I'm hoping they don't split the cases and wait out the appeal. He has their number.

olddog, thank you very much for bringing this to the board. Things like this give color to what is going on behind the scenes, especially to those of us who do not have any direct litigation experience. I recommend to all that you take the time to read it, it is very interesting to see how the judge deals with issues. It doesn't really reveal any significant new information, but it gives you an understanding of what is going on at the various hearings and how the judge handles the parties and is very no nonsense about it. Thanks again.

this judge is nononsense and NOK is really pissing him off.

he really gets into the NOK atty's for bringing up the TDD defense this late in the game. It is apparent he sees right thru their delay tactics... and one has to wonder if they really want to go to trial.

Nok really got a lifeline with the Batts decision, but they are really close to the cruise ship's blades. If they lifeline gets cut...if the appeals court does the right thing, then watch IDCC unleash the dogs. since SAM has no leg to stand on via the TDD, do they really sit idle waiting for that decision?

The ALJ does try to save some face for the NOk atty's near the end when he says, "no way, i ain't siding with the defense" ... but you can't feel good if you were on the dark leaving that phone conference.
