I think he absolutly must do it if he is to maintain any credibility for the ITC. Absolutly no reason I can come up with that would cause prejudice to either nokia or samsung. In fact, Even if there were a good reason not to, look how Luckern has handled nokia throughout. He ain't no dummy. Sure, he threw them a bone by originally allowing the consolidation. However, outside of that, it's all gone IDCC's way. He surely sees nokia for who they are. He grants their motion to consolidate, expends his time and U.S. tax dollars conducting discovery, and listens to nokia's BS for months, and what does nokia do? They give him the finger and tell him to f__k off! The only one who will benefit from his failure to sever (assuming he at least lifts his suspention if we lose our appeal of batts order) will be nokia. Based on his prior rulings, I don't see him doing anything that might benefit nokia at this point. Caveat: see Batts' decision
