If we get another Judge who is the equivalent of Batts, I wouldn't bet on that. I am certain there are more Judges like Batts out there just waiting to get assigned to IDCC.(LOL)

Call me goofy, but I think the collateral estoppel issues will be resolved in favor of IDCC and if the wait is 60 days or less it is worth it. If IDCC attempts to sever, Nok will just attack in 2 0r 3 jurisdictions trying to block same and then we just have more BS to wade through. If we can put both to trial in June, I say let's go for it.

If we lose for some reason on the collateral estoppel issue, it may be time to stop paying lawyers and hire ex CIA agents to find out the cause of Nok remarkable success in our court system.
