You can believe anything you want, but giving away an existing appeal to hold Samsung's feet to the fire in the ITC proceedings is not a good idea. One of the reasons that the ALJ poured Nok out on its motion for stay and arbitration was the beneficial extension of time awarded Samsung on the basis of the litigation efforts of Nok. Once again IDCC is faced with an extension for Samsung as a result of litigation efforts by Nok. This is irreparable harm folks because we can never get that 6 months back unless our engineers invent a time machine. These are matters that should and must be pointed out to the 2ndCCA in order to get a preliminary stay and were not resulting in a denial making us believe that Nok has these mystic powers. You cannot hit what you cannot see.
