Another thing to consider.

As long as the ITC investigation is suspended, I do not believe NOK can go to Judge Batts and ask for a motion to terminate as per the order of Judge Batts because the ITC is in effect stayed.

If the ALJ did not act on the motion to stay, I thought there was a possibility that NOk would have gone back to Judge Batts and order IDCC to file a motion to terminate.
