As I replied to loophole and see my post on the meaning of pending and then go to the 8-K see if you can interchange all the various meaning of "pending".
I think if IDCC wanted to be less vague, IDCC could have wrote," pending the start of... ," or "pending the conclusion of....."

I think IDCC does not only want to see the expedited schedule but also how the settlement discussions are progressing before deciding the severing of the NOK and Samsung investigations.
