When you read the Judges 11/1 ORDER following the 10/26 hearing where the setlement was announced, it was laid out that this settlement and the appointment of a new Trustee would solve the "tug of war" (see bottom of page 1 and the top of page 2). Also, the potential dollar settlement from JP Chase was very limited absent proof of fraud; it's one thing to prove the trustee was negiligent, but very very difficult to prove that he was out to defraud our trust. So, yes JP Chase was able to slip away relatively unscathed for all the damage they caused, because they had the standing issue as a shield which would likely have delayed the case for months. They also could have declared the trust bankrupt, which would not only have delayed things, but also would have moved the case to a different uncertain venue. But we've got two defendants left, and they have deep pockets that will right their wrongs and JP Chase is no longer in the corporate trustee business, so that's some measure of revenge for some of us old moshers.
