But when the litigants get judgments against CBAY, they will be able to attach CBAY assets - of which there are none now. But if CEO adds his own properties to the CBAY portfolio, I would think that the litigants can then attach those new assets. So at some point the litigants' claims need to be addressed before CBAY can prosper. Why not settle those claims now instead of allowing them to be a drag on the profits and therefore delaying a return of the CEO's investment. Any savvy investor or businessman knows about the time value of money. See why I have such a hard time buying into Rizvi?
