They either lied or they did not there is no middle ground. Lawyers are very clear in what they say. If they believed they could not win that is what they would say.

Of course the lawyers arent going to say "we cant win" so they spin it by saying its not profitable enough for us to pursue.

Sorry, Big_Jake, but that's just not how it works in the real legal world. Speaking from experience, I can tell you that when lawyers either reject cases at the outset, before filing suit, or dismiss lawsuits when they've already been filed, they tell the clients the REAL REASONS for doing so. Not to do so would be a violation of their inherent duties to the clients, not to mention their Bar ethics rules.

And I'll bet you're wrong about the OSC. In my opinion, they'll have no need for "poor excuses and lame duck reasons" when their findings are made public. Nor will they be issuing any apology to the company and its shareholders.
