All true, but these law suits are simply another form of scam. They're not often about anything the company did wrong. They're about extracting money from the company and/or its insuror. Usually, lots of claims are made so that the company would have to spend a whole lot of time and money addressing them and will have doubts as to whether a jury would dismiss all of them. Juries are notoriously of a compromising nature.

I did not mean to imply that there was any validity to this Class Action Suit. I only meant that it was assumed that the "ambulance chasers" would be around sooner or later.

My experience, FWIW , has been that Class Action Lawsuits of this type are nothing more than some lawyers ( "ambulance chasers" ) out to make some money.

Like you mentioned, for example, DNDN management can not possibly control the fact that the FDA decided to render their proclamation earlier than the May 15th date.

Stocks go up and stocks go down. Past performance is no indication of future results. You place your bets and take your chances ( so to speak ).

Unless the company's management does something along the lines of Enron, I think that lawsuits are a complete joke. No wonder lawyers have the reputation that they have. ( No offense to the lawyers that are not of this type ).
