I don't think they are being sued, I think that they are being warned by the courts that if they don't do what they are supposed to do, they will be sued. I cant imagine TM sueing them now, that would hold everything up for years in the legal system. Just a warning shot so to say. In other words, don't play games with my company, because I'm not playing that game. JMHO
