The "Cancer Companys vs. WS" does matter. To get damages you must convince a jury there was wrongdoing on the defendants part. Cohen will have a field day with this narrative as would any high-stakes security's litigator. It will be framed as that once the Jurors are seating, no ifs, ands and buts about it. It absolutely does matter and I suspect maximum damages will be levied by the Jury. Damages could be changed by the Judge, but that remains to be seen. You also bring up a decent point:

Discovery could allow for that number to be changed. As a matter of fact, other defendants can be added, and/ or even another lawsuit can be filed. So the narrowed limit was agreed to by Cohen strategically to proceed with discovery.



If NW and Cohen uncover everything, it is legitimate to think criminal charges may follow, or other civil lawsuits surrounding naked-shorting may pop-up. Its like opening Pandoras Box for the Market Makers. Not only from NW, but every other Companys who feels their stock has been spoofed. NW is showing the road-map to make it to trial. This will cost the MMs millions in legal fee's defending themselves. There is a reason why Canacord settled. The rest will follow suit in due time.

Sure, discovery could theoretically uncover new facts. But adding defendants, amending claims, or filing a new lawsuit would likely add motions, briefing, more discovery, more delay, and possibly years to the case.

NWBO is already on financial life support. Extending the litigation timeline by years is not a cure. It is more delay.

The Canaccord settlement points the other way. NWBO settled with one defendant, and the 10-Q says funds are in escrow while it pursues discussions with other lesser defendants. That sounds more like NWBO looking for quicker, certain resolutions than trying to turn this into an even longer heroic jury fight.
