Baxer, Exactly. And a procedural legal finding of "insufficient pleading" for "some" shares in question, just means they required a tighter link for those shares. It does not mean an economic reality of market caps dropping, didn't happen.
And as Flipper said discovery can change things. An "inside witness" can remove the biggest barrier of all:
- access to more data
- and help prove intent.
It is easier to show “coordinated spoofing" which is a much “higher level” of guilty and liability verdict, meaning less wiggling out, less squealing, less allocation of fault, fewer excuses, and bigger and faster settlement payments.
