The accounting, as you say, will be through 12/31. The text, on the other hand, is free to discuss what's happening up to the minute, if they so choose.
While it would be great if some good news occurred between now and then, but even if not, the company is free to discuss what can be discussed, it's doubtful that anything that's transpiring between them and the regulators will be discussed unless it's an official act that can be.
You are correct that the audited financials are through Dec 31, but the subsequent events will be current up to a few days prior to the filing. Those will show all liquidity events such as the $250M cash received and any other stock sales / loans past EOY.
