You play semantics. Trump doesn't understand his 'punishable by death' applies to him more than it applies to them.

#556824 RE: OMOLIVES #556821

Short answer. The UCMJ is CLEAR about the obligation by members of the military to not follow illegal orders.

MY take is that reminding members of that obligation is not imprudent much less illegal.

Jack shit will come come from Kegseth's partisan probe.

18 U.S.C. § 2381 defines treason for civilians as levying war against the U.S. or aiding its enemies, punishable by death or at least five years imprisonment and a $10,000 fine. President Trump labeled a video by six Democratic lawmakers—including Sen. Mark Kelly—as "seditious behavior" punishable by death, but legal experts note the video urged troops to reject illegal orders, which aligns with military law and does not meet treason's strict criteria.

Kelly, a retired Navy captain still subject to the Uniform Code of Military Justice due to his active-duty retirement status, faces a Navy review ordered by Defense Secretary Pete Hegseth, potentially leading to administrative actions like rank reduction rather than court-martial.[1][2][3][4][5][6][7]

## Incident Background
Six Democratic lawmakers released a video on November 18, 2025, advising service members to disobey unlawful orders. Trump called it treasonous on Truth Social, prompting Pentagon probes focused on Kelly as the only one with retiree status under UCMJ. The Navy submitted its report to Hegseth by December 11, but details remain private, and experts doubt viable charges due to free speech protections and separation-of-powers issues for a sitting senator.[8][3][4][9][10][1]

## Legal Applicability
Treason under 18 U.S.C. § 2381 requires overt acts like aiding enemies, far beyond political speech. Military retirees like Kelly can face UCMJ recall (10 U.S.C. § 688), but Hegseth cited 18 U.S.C. § 2387 for undermining morale, which also demands specific intent not clearly met here. Courts would likely dismiss extreme penalties, viewing the video as standard reminders of oath-bound duties.[3][11][5][12][13][14]

## Assessment of Actions
The lawmakers' video risked politicizing military loyalty amid tensions, appearing provocative though legally defensible. Kelly's experience as a combat veteran and astronaut suggests he understood UCMJ implications better than non-veterans, making his involvement riskier. Actions like Hegseth's probe signal accountability but border on partisan overreach without clear violations. Overall, it was imprudent escalation from all sides, unlikely to yield prosecutions.[15][8]
