Okay. Your reliance on "off-balance sheet," like use of "safe harbor" here, is unrealistic. It doesn't mean a bankrupt company had a bunch of assets that they don't have to declare in bankruptcy. Look it up. And off-balance sheet assets and liabilities must be accounted for and disclosed.
