The DOJ has had 3 months to chime in and didn't. Could it just be grandstanding?

It may be, given that Bondi's in charge. But in court, you can't just file whatever you want, when you want. One side files, and then other parties have a specified amount of time in which to file an opposition, or whatever they choose to file. Then--and if the court does grant cert--it's possible some amici curiae could decide to weigh in, which would mean they'd have to make themselves known to the judge and then file their own stuff. So it could take some time.

And the DOJ did file an opposition to Maxwell's petition for a writ of certiorari.

First, what's needed is for SCOTUS to decide whether to grant cert or not. I wish they would, but my guess is that they won't.
