I believe there is a caveat to that provision as the company also has to be Deficienct in another listing requirement.

The “new rules” have a massive loophole you could drive a Bollinger B3 through.

MULN’s last RS was done under the “new rules”.

It appears as long as you get it done prior to a hearing you are good to go regardless of the cumulative effect.

That is why MULN needs to file their Pre14C soon.
