Scotty, while I'd agree the Judge didn't help NWBO as much as he could, he also didn't hurt them as much. I do believe the market will see what he did as positive, but not a major positive. If a settlement is reached, resulting in many millions coming in before NWBO has received approvals worldwide, I believe that would be a bigger positive.
If on the other hand no settlement is arrived at, if it takes years to go to trial, and then if a substantial penalty judgement goes against the 7 MM's and NWBO receives hundreds of millions, I believe it would have less impact. Why? Because by that time NWBO would routinely be earning billions and even a big judgements, given the Judge's reduction in the size of the case, wouldn't have that great an impact.
The key to success, as always, is not the suit, but approval of our products. With approvals, our success will be assured, without it, no court ruling will make for real success.
Don't get me wrong, tens to hundreds of millions near term would be a big positive, but only if added to approval. Without approval it can only bump us up a bit temporarily, but will have little long term influence.
I still believe our initial approval from the UK won't be much longer, that's what will lead to real success, not what happens in the suit.
