The attorneys took the case on contingency. Discovery will cost NWBO nothing. A judgment (in the absence of a settlement) would come with attorney fees.

I believe that Posner has enough invested that she won't drop it at this point. I'm sure that she and her law firm will at least be reasonably compensated for their costs in the action.
