Have to disagree with all the "oh, they can't do this because ...."

Other biotech companies deal with it all the time. The spoofing is illegal and cal go after it. But for years NWBO had zero offense against this and they still show zero game capabilities through the years. They stated the were going after AF almost a decade prior to sooofing. And what happened? NOTHING. 

The best defense is a good offense or a good team player in a BO partnership that they probably could have had in 2015. The loss in eventual profits would have been about ten times less.
