The bottom line is that owners of patents do not legally “infringe” those assigned/owned patents by introducing products or carrying out processes that are within the scope of claims of those patents. The patent statutes provide (my paraphrase) that patent owners may “ exclude others” who, without authorization, make, use, sell, offer to sell, or import products or processes that are within the scope of claims of those patents.
