Thanks Brusselsspirit. Silvr, though ANIP or their partner are willing to take the Supreme Court, I don't think CGON will gamble losing the IND and data needed to make an NDA filing. It is too big a gamble for 5% of global sales. Though it is the perfect case to settle the matter as it relates to the pharma industry's lengthy drug approval process.
This case in D.C. Superior Court appears to be ancillary to the ANIP case in the Delaware state court. It seeks production of ~ 9 separate categories of listed documents from ATCC( HQ is in D.C.) that are said/averred via plaintiff’s attorney’s affidavit or declaration to be related to the defendant in the Delaware case pursuant to contracts/agreements between ATCC and Delaware defendant.
