Totally wrong. DBMM Dismissal was and is the Standing Order and the Final Order maintained it as a precedent. The Dismissal was based on the Company's mitigating circumstances which were acknowledged by ALJ Foelak and every regulator thereafter.
Revisionist history not the case and your opinion does not comport with the law. Likewise when CE removed.
